By accessing or using our Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.
These Terms constitute the sole and entire agreement between you and EduCube regarding your use of the Services. Your access to and use of the Services means you agree to comply with the current and future provisions of these Terms and our Privacy Policy. If you are using the Services on behalf of an organization (such as your school or educational institution), you represent and warrant that you have the authority to bind that organization to these Terms. In such cases, 'you' or 'user' refers to both you individually and the organization you represent. EduCube reserves the right to revise or update these Terms at any time, unilaterally and without specific notice to you. Updated Terms become effective as of the date they are posted on the EduCube website. It is your responsibility to review these Terms periodically. If at any time you find these Terms unacceptable, you must immediately stop using the Services. EduCube reserves the right to take any legal action, including suspending or terminating your account, in the event of a violation of these Terms.
EduCube provides interactive educational products, applications, and related website services designed for children and educational purposes. Our Services are intended to support learning, provide engaging content, and deliver educational experiences. You agree to use our Services only for lawful, ethical, and permitted purposes in accordance with these Terms. You are responsible for ensuring that your use of the Services complies with all applicable local and international laws and regulations, especially those related to children's online safety and privacy.
Access to certain features of our Services may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials (username, password, etc.) and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any security breach. Child Users: EduCube provides content specifically for children. Therefore, the age of our users is of great importance: Children Under 13: If an account is created or the Services are used by a child under 13, you must be the child's parent or legal guardian, or have obtained explicit and appropriate consent from the parent or legal guardian. EduCube disclaims any responsibility for activities performed by children under 13 without parental/legal guardian consent. You are fully responsible for monitoring and supervising your child's use of our Services. We strongly recommend that parents/legal guardians observe their children's online activities and behavior while using our Services. Teens Aged 13-18: Individuals between 13 and 18 years old must obtain permission from their parents or legal guardians (the 'Family') to use the Services. The Family may provide such consent through the Services or other authorized channels. Revocation of Consent: If the Family wishes to withdraw consent, we recommend discontinuing the child's access to and use of our Services. By starting to use the Services or creating an account, you agree to comply with these age restrictions and related statements.
All content, features, and functionality of our Services—including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, software, code, themes, characters, names, dialogues, concepts, copyrightable works, animations, music effects, moral rights, documents, in-app messaging transcripts, and server software—are the exclusive property of EduCube or its licensors and are protected by copyright, trademark, patent, and other intellectual property laws. EduCube grants you a limited, non-exclusive, non-transferable, and revocable license to use our Services solely for personal, non-commercial, and intended educational purposes. Unless expressly permitted by law or with our written consent, you may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of any part of our Services or included software.
Our Services may allow you to submit, upload, share, or create content ('User Content') through certain features. You retain ownership of any intellectual property rights you hold in your User Content. However, you grant EduCube a worldwide, royalty-free, non-exclusive, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, publicly display, distribute, and sublicense such User Content in connection with our Services (e.g., to operate, develop, promote, publish, store, and distribute the Services). You are solely responsible for any User Content you submit, upload, or share, and you represent that you have all necessary rights and permissions to share such content. You warrant that your User Content does not infringe the rights of any third party (including copyright, trademark, privacy, publicity, or other personal or proprietary rights) or violate any law or regulation.
When using our Services, you agree not to engage in the following activities: - Violate any applicable law, regulation, or ordinance. - Infringe or misuse the rights of others (including intellectual property and privacy rights). - Use the Services to distribute harmful code, viruses, worms, trojans, or other malicious software. - Attempt to gain unauthorized access to our Services, systems, servers, or networks. - Engage in any activity that could disable, overload, damage, disrupt, or impair the operation of our Services. - Share, upload, display, or distribute content that is harmful, obscene, pornographic, defamatory, threatening, racist, or hateful, especially content inappropriate for children. - Cheat, hack, manipulate the operation of the Services, or attack servers connected to the Services. - Send unsolicited emails, advertisements, or promotional materials ('spam') via or through the Services. - Sell, rent, transfer, or assign your account; create accounts with false or misleading information. - Immediately cease any conduct if requested by an EduCube employee. - Process or store other users' personal data without authorization while using the Services. - Use only your own credit card or payment method for payments made through the Services (if any). - Use the EduCube brand, service marks, or similar in any harmful or misleading way. - Disrupt the normal flow of the game or application, or engage in conduct that prevents others from using the Services. - Modify, reverse engineer, or attempt to extract the source code of any part of the Services or mobile application without EduCube's written consent. - Create or use any third-party software designed to cheat, 'mod', or hack EduCube games; use any third-party software that interferes with, disrupts, or collects information from an EduCube game. If you violate any provision of these Terms, engage in cheating or fraudulent conduct, or commit any unlawful act through the Services, we may, at our sole discretion and without notice, suspend, restrict, or terminate your access to the Services. In particular, if you engage in any criminal or unlawful act detected by or reported to EduCube, the matter will be reported to the relevant authorities, and you agree not to make any claims against EduCube if any action is taken against you as a result.
If the EduCube Services offer the ability to purchase or earn virtual currency, in-game credits, or other virtual products ('Virtual Items'), the following terms apply: Nature of Virtual Items: Virtual Items are licensed, non-transferable, non-refundable items that you may acquire solely for use within the Services, typically by using real money. (a) You may make in-app purchases (Virtual Items); and (b) you may purchase other goods and services related to the Services for personal, non-commercial use only. Virtual Items may only be purchased from EduCube or authorized service providers. Ownership: All rights and interests in the Services (including games, titles, computer code, themes, objects, characters, names, dialogues, concepts, copyrightable works, animations, sounds, music effects, moral rights, documents, in-app messaging transcripts, and server software) belong to or are licensed to EduCube. You acknowledge that you have no ownership rights in any Virtual Items. Virtual Items are provided solely for entertainment purposes and remain under EduCube's control. Management and Modification Rights: EduCube may manage, control, modify, or remove Virtual Items at any time, with or without notice, for any reason. EduCube shall have no liability to you or any third party if it exercises these rights. Regardless of any payment made, you have no ownership or other rights in any Virtual Item. Prohibited Transactions: Unless expressly authorized by EduCube: (i) transferring Virtual Items to other users is strictly prohibited; (ii) selling or transferring any Virtual Item for 'real money' or any consideration outside the Services is strictly prohibited; and (iii) EduCube does not recognize the gifting or trading of Virtual Items as valid. Any violation of these provisions will result in the automatic termination of your rights to use Virtual Items and may result in the termination of your account. If your account is terminated or EduCube ceases to provide the Services for any reason, all access to Virtual Items will be lost. Refund Policy: All sales made through the Services are final. You acknowledge that any payments or fees (including for Virtual Items) are non-refundable, in whole or in part. You are responsible for all payments made from your account, regardless of whether they were authorized by you. EduCube does not provide refunds for any fees or purchases made through the Services. Unless otherwise required by applicable law, payments made through the Services are not subject to refund, and unused Virtual Items will not be refunded if your account is terminated for any reason. Price and Content Changes: EduCube may change the availability, prices, content, descriptions, or in-app virtual product offerings at any time. The inclusion of any product in the Services at a particular time does not guarantee its future availability. Changes become effective upon publication of new prices.
Our Services are provided 'as is' and 'as available' without any warranties of any kind, either express or implied. EduCube does not warrant that the Services will meet your requirements, be uninterrupted, secure, error-free, or free from viruses or other harmful components. We make no guarantees regarding the results that may be obtained from the use of the Services. Information provided through the Services may contain errors, problems, or other issues. EduCube and its authorized third parties have no liability for any such issues.
To the maximum extent permitted by law, EduCube shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, business interruption, or other intangible losses, even if EduCube has been advised of the possibility of such damages. To the extent permitted by law, EduCube's liability to you for purchases made within the Services shall not exceed the amount you paid to EduCube. These Terms do not affect any minimum rights you may have under applicable law, and EduCube remains liable for damages caused by its willful misconduct or gross negligence. If you cause any loss, liability, claim, or expense (including attorney's fees) to EduCube, its employees, directors, officers, affiliates, or partners as a result of your willful misconduct or negligence, or if any third party makes a claim against EduCube due to your use of the Services or violation of these Terms, you agree to indemnify and hold EduCube harmless. However, this does not apply if the violation cannot be attributed to your willful misconduct or negligence.
If the EduCube Services store game or application data ('App Data'): You acknowledge and agree that you do not acquire any ownership rights in App Data as a result of using the Services. All electronic files, application characters, accounts, in-app virtual currency, statistics, user profiles, and similar data within the application are owned and stored by EduCube. While EduCube prioritizes the security of such data, it is not liable for any loss of data for any reason. In particular, you acknowledge and agree that you have no ownership rights in any in-app virtual currency purchased or otherwise obtained within the application. EduCube retains exclusive rights to all in-app virtual currency, which is considered App Data and is provided solely for entertainment purposes.
EduCube takes various legal measures regarding copyright infringement that may occur through its website or Services. If EduCube learns of any copyright infringement through the Services, it has internal policies in accordance with intellectual property law and regulations regarding takedown and/or termination procedures. EduCube investigates copyright infringements under this policy. If you have evidence and sincerely believe that a third party's copyright has been infringed, please provide the following information so EduCube can take appropriate action: - A description or list of the copyrighted works claimed to have been infringed. - Information about the allegedly infringing content (including its location or URL). - Your address, phone number, and, if available, email address so EduCube can contact you. EduCube may block your access to the website or terminate your use of the Services at any time if it believes these Terms have been violated.
If you violate any provision of these Terms or use the Services unlawfully, or if there is any suspicion thereof, EduCube may, without notice and in addition to other remedies, restrict, suspend, terminate, or delete your account or access to the Services. In addition to other remedies, if you violate these Terms or infringe the intellectual property rights of EduCube or third parties, we may restrict, terminate, or suspend user accounts or access to the mobile application, website, or games, or take any technical or legal measures to immediately terminate your use. If you pose any legal risk, we may also apply these remedies and, at our sole discretion, suspend or terminate the accounts of users who infringe the intellectual property rights of others.
If the EduCube Services include forums, messaging, or other communication tools ('Communication Areas'), the following rules apply: By posting any content in Communication Areas, you acknowledge that such content may be stored on EduCube servers. If you share any personal information in Communication Areas, you acknowledge that it may be viewed or obtained by unknown persons. You share such information at your own risk, and EduCube makes no guarantees regarding its security. It is strictly prohibited to post any illegal or offensive content or links to such content in any Communication Area. If illegal content is posted and reported to EduCube, or if EduCube detects such activity, the content will be removed immediately and reported to the authorities. EduCube reserves the right to: - Monitor Communication Areas and all communication tools within the Services; - Report any suspected illegal activity to the authorities; and - Remove or disable any user who violates these Terms or deactivate their account. EduCube is not responsible for any illegal chat, correspondence, sharing, or similar content in Communication Areas, and you are solely responsible for your own communications. If you encounter any illegal content while using Communication Areas or any communication channel within the Services, please report it directly through the in-app help section or by contacting info@educube.com.tr.
In the event of a dispute between you and Educube, Educube encourages the dispute to be resolved through good faith negotiations by contacting Educube via email at info@educube.com.tr. If the dispute between you and Educube cannot be resolved through good faith means, you agree that Turkish law will apply to the dispute and that the Ankara Courts will have jurisdiction.
If any provision of these Terms is found to be invalid under applicable law, the remaining provisions shall remain in full force and effect and shall not be affected by the invalidity of any specific provision.
EduCube shall not be liable to users for any failure to perform its obligations due to events beyond its reasonable control, including but not limited to war, terrorism, embargo, fire, flood, earthquake, extraordinary economic changes, civil or military uprisings, or pandemics.
